AN EMERGENCY FOR SECTION 23 OF THIS ACT.
45 Be It Enacted by the Legislature of the
State of Idaho:

1 SECTION 1.
The following amount shall be expended from state sources for
2 public schools for the period July 1, 2001,
through June 30, 2002:

12 SECTION 2.
There is hereby appropriated from the General Fund for public
13 schools, the following amount to be transferred
to the Public School Income
14 Fund for the period July 1, 2001, through
June 30, 2002:

17 SECTION 3.
There is hereby appropriated from the Public School Income
18 Fund to be expended for the Educational
Support Program pursuant to law and
19 the provisions of this
act, an amount not to exceed $992,844,800 for the
20 period July 1, 2001, through June 30, 2002.
21 SECTION 4.
Of the moneys appropriated in Section 3 of this
act, the
22 amount necessary for the
Unemployment Insurance Program shall be expended
23 according to Section 72-1349A, Idaho
Code, for the period July 1, 2001,
24 through June 30, 2002.
25 SECTION 5.
That Section 33-1004E, Idaho Code, be, and the same is hereby
26 amended to read as follows:
27 33-1004E.
DISTRICT'S SALARY-BASED APPORTIONMENT. Each district shall
be
28 entitled to a salary-based apportionment
calculated as provided in this sec-
29 tion.
30 1. To determine
the apportionment for instructional staff, first deter-
31 mine the district average experience and
education index by placing all eligi-
32 ble district certificated instructional
employees on the statewide index pro-
33 vided in section 33-1004A, Idaho Code. The
resulting average is the district
34 index. Districts with
an index above the state average index shall receive
35 their actual index but not more than
the state average plus .03 for the
36 1994-95 school year, and
shall receive their actual index but not more than
37 the state average plus .06 for the 1995-96
school year, and thereafter shall
38 receive their actual district
index. The district instructional staff index
39 shall be multiplied by the instructional
base salary of $20,915
23,210. The
40 amount so determined shall be
multiplied by the district staff allowance for
41 instructional staff determined as provided
in section 33-1004 2., Idaho Code.
42 If an instructional staff member has
been certified by the national board for
43 professional teaching standards, the staff
member shall be designated as a
44 master teacher and receive
$2,000 per year for five (5) years. The instruc-
45 tional salary shall be increased by
$2,000 for each master teacher. The
46 resulting amount is the
district's salary-based apportionment for instruc-
47 tional staff. For purposes of this section,
teachers qualifying for the salary
48 increase as master teacher shall be those
who have been recognized as national
49 board certified teachers as of July 1 of
each year.
50 2. To determine
the apportionment for district administrative
staff,

1 first determine the district average experience
and education index by placing
2 all eligible certificated administrative
employees on the statewide index pro-
3 vided in section 33-1004A, Idaho
Code. The resulting average is the district
4 index. Districts with an index above the
state average index shall receive
5 their actual index but not more than the
state average plus .03 for the school
6 year 1994-95, and shall receive their actual
index but not more than the state
7 average index plus .06
for the 1995-96 school year, and thereafter shall
8 receive their actual district index. The
district administrative staff index
9 shall be multiplied by the base
salary of $30,599 33,760.
The amount so deter-
10 mined shall be multiplied by the district
staff allowance for administrative
11 staff determined as provided in section
33-1004 3., Idaho Code. The resulting
12 amount is the district's salary-based apportionment
for administrative staff.

3. To determine the apportionment
for classified staff, multiply
14 $16,232
18,463 by the district classified
staff allowance determined as pro-
15 vided in section 33-1004 4., Idaho Code.
The amount so determined is the
16 district's apportionment for classified
staff.
17 4. The
district's salary-based apportionment shall be
the sum of the
18 apportionments calculated in subsections
1., 2. and 3., of this section, plus
19 the benefit apportionment as provided in
section 33-1004F, Idaho Code.
20 SECTION 6.
The State Department of Education shall have the authority to
21 monitor and evaluate the use of funds appropriated
to public school districts
22 for enhancement programs.
23 SECTION 7.
Of the moneys appropriated in Section
3 of this act,
24 $10,400,000 shall be expended
by the Superintendent of Public Instruction as
25 follows: $3,135,000 for ongoing
expenditures and $7,000,000 for one-time
26 expenditures for the Public School
Technology Grant Program upon direction of
27 the Idaho Council for Technology in
Learning, in accordance with Section
28 33-4806, Idaho Code; and
$265,000 to be transferred to the Library Services
29 Improvement Fund for the State Library's
"Libraries Linking Idaho" (LiLI)
30 statewide database licensing project.
31 SECTION 8.
Of the $10,400,000 referred to in Section 7 of this act, an
32 amount not to exceed $173,000 shall be expended
by the Superintendent of Pub-
33 lic Instruction for staff
support and various expenses related to the Idaho
34 Council for Technology in Learning as approved
by the State Board of Educa-
35 tion.
36 SECTION 9.
Of the moneys appropriated in Section 3 of this act, $425,000
37 shall be distributed by the Superintendent
of Public Instruction as grants to
38 teachers or groups of teachers for
the development of creative and innovative
39 instructional methods or curriculum.
40 SECTION 10.
Of the moneys appropriated in Section
3 of this act,
41 $4,575,000 shall be distributed for support
of programs for students with non-
42 English or limited-English proficiency as
follows: $100,000 may be utilized by
43 the Superintendent of Public Instruction
to study the costs and effectiveness
44 of education of Hispanics and other limited-English
proficiency students. All
45 remaining funds shall be allocated to school
districts pro rata based upon the
46 population of limited-English
proficient students under criteria established
47 by the State Department of Education.
48 SECTION 11.
Of the moneys appropriated in Section
3 of this act,
49 $2,000,000 shall be distributed by the State
Superintendent of Public Instruc-

1 tion for a program of administrative
and supervisory support, mentoring, peer
2 assistance and professional development.
Payment shall be distributed to
3 school districts pro rata, pursuant
to the provisions of Sections 33-514 and
4 33-514A, Idaho Code.
5 SECTION 12.
Of the moneys appropriated in Section
3 of this act,
6 $4,700,000 shall be expended
by the Superintendent of Public Instruction for
7 the Idaho Safe and Drug-Free Schools Program,
from funds determined by avail-
8 able revenues accruing pursuant to
Sections 63-2506 and 63-2552A, Idaho Code,
9 and other such moneys which may become available
pursuant to Section 67-7439,
10 Idaho Code, for the period July 1, 2001,
through June 30, 2002.
11 SECTION 13.
The funds allocated for the Idaho Safe and Drug-Free Schools
12 Program referenced in Section 12 of this
act shall be distributed as follows:
13 $100,000 may be utilized by the Superintendent
of Public Instruction for pro-
14 gram administration, technical assistance
and evaluation. Of the remaining
15 amount, ninety-five percent (95%) shall
be distributed to each school district
16 through a combination of a base
amount of $1,500 and a prorated amount based
17 on the prior year's average daily attendance.
Of the remaining five percent
18 (5%), $80,000 shall be
distributed on a one-time basis to the Commission on
19 Hispanic Affairs and used to encourage and
direct Hispanic youth away from the
20 habitual use of tobacco, alcohol and other
drugs by developing programs for
21 schools, families and communities, with
the remainder used to make discretion-
22 ary grants as determined
by the Drug-Free Schools and Communities Advisory
23 Board.
24 SECTION 14.
It is legislative intent that the Idaho Safe and Drug-Free
25 Schools Program shall include the following:
26 (1) Districts
will develop a policy and plan which will provide a guide
27 for their substance
abuse program.
28 (2) Districts
will have an advisory board to assist each district in mak-
29 ing decisions relating
to the program.
30 (3) The districts'
substance abuse programs will be comprehensive to meet
31 the needs of all
students. This will include prevention programs, student
32 assistance
programs that address early identification and referral, and
33 aftercare.
34 (4) Districts
shall submit an annual evaluation of their program to the
35 State Department
of Education as to the effectiveness of their program.
36 SECTION 15.
Of the moneys appropriated in Section
3 of this act,
37 $1,000,000 shall be distributed for the
following:
38 (1) Training
of regular classroom teachers in working with children with
39 disabilities;
40 (2) Employing
and training aides to assist regular classroom teachers in
41 working with children
with disabilities;
42 (3) Employing
substitute teachers whose employment allows regular class-
43 room teachers to
be involved in college planning, parent contact, Individ-
44 ual Education
Plan (IEP) development, curriculum and modification,
or
45 other necessary
activities directly related to meeting the needs of stu-
46 dents in regular
education classrooms;
47 (4) Moneys
in this section shall be distributed pro rata to the districts
48 as follows:
fifty percent (50%) on the basis of the prior year's December
49 1 child count and
fifty percent (50%) on the basis of the prior year's
50 average daily attendance.
51 These funds shall be used to supplement
rather than supplant existing efforts

1 in the training of regular classroom teachers
and the employment and training
2 of aides. The State Department of
Education shall create a one page report to
3 be provided to the Legislature showing current
individual district expendi-
4 tures in this area, as
well as a breakdown of how these appropriated moneys
5 were spent. These funds shall not be used
in any calculation or report to the
6 federal government that obligates a future
appropriation of this amount or any
7 other amount.
8 SECTION 16.
Of the moneys appropriated in Section 3 of this act, $600,000
9 shall be used as follows: $100,000
shall be allocated to study the effective-
10 ness and best practices of gifted and talented
programs. The remainder shall
11 be distributed to train
general education teachers, gifted/talented (G/T)
12 facilitators, administrators and/or
parents to better meet the needs of
13 gifted/talented students. One-half (1/2)
of these funds shall be allocated pro
14 rata based on each district's prior
year total student enrollment compared to
15 the prior year total statewide enrollment.
One-half (1/2) of these funds shall
16 be allocated based on the number of gifted/talented
students identified and
17 served as indicated on the prior year's
December 1 child count. The number of
18 gifted/talented students identified for
purposes of this section shall not
19 exceed seven percent (7%) of the district's
total student enrollment. No dis-
20 trict shall receive less than $500. Funds
shall be distributed upon submission
21 and approval of an application submitted
to the State Department of Education
22 demonstrating how in-service training will
establish or improve identification
23 and service of gifted/talented students
in the five (5) mandated talent areas.
24 The Superintendent of
Public Instruction may reallocate any gifted/talented
25 funds that are left unrequested by school
districts to all other school dis-
26 tricts that have requested gifted/talented
funds, according to the distribu-
27 tion formula outlined in this section.
28 SECTION 17.
Of the moneys appropriated in Section 3 of this act, there is
29 hereby appropriated the amount necessary
for property tax replacement, to be
30 expended according to
Section 33-1002D, Idaho Code, for the period July 1,
31 2001, through June 30, 2002.
32 SECTION 18.
Of the moneys appropriated in Section 3 of this
act, an
33 amount up to $418,000
shall be awarded to those instructional staff members
34 who have been recognized as master teachers
by the National Board for Profes-
35 sional Teaching Standards,
according to the provisions of Section 33-1004E,
36 Idaho Code.
37 SECTION 19.
Whereas the Legislature recognizes that due to the reduction
38 of Public Employee Retirement System
rates and the reduction of the estimated
39 support units used to establish budgets
for Idaho's school districts, an addi-
40 tional and substantial amount of state discretionary
funding per support unit
41 will become available. It is therefor
the intent of the Legislature that this
42 additional state financial support, together
with those amounts estimated in
43 the regular fiscal year 2002 budget,
be utilized by the school districts as a
44 one-time supplement to discretionary funding
needs.
45 SECTION 20.
Of the moneys appropriated in Section
3 of this act,
46 $4,000,000 shall be used
for literacy programs, as outlined in Sections
47 33-1614, 33-1615 and 33-1207A(2), Idaho
Code.
48 SECTION 21.
No full-time instructional employee employed by a school dis-
49 trict shall be paid less than the base salary
amount for instructional staff

1 provided in Section 33-1004E, Idaho Code.
2 SECTION 22.
Of the moneys appropriated in Section
3 of this act,
3 $8,000,000 shall be for the implementation
of Achievement Standards estab-
4 lished under the provisions
of the rules of the State Board of Education,
5 IDAPA 08.02.03. These funds shall be distributed
according to formulas and
6 criteria established by the Superintendent
of Public Instruction.
7 SECTION 23.
Each school district board of trustees shall examine whether
8 school district employees are using personal
funds to pay for classroom sup-
9 plies. If the board of trustees
finds this to be true, then the board should
10 allocate up to twenty-five percent
(25%) of any savings generated from
11 gainsharing credits allocated
by the Public Employee Retirement System of
12 Idaho pursuant to Section 59-1309, Idaho
Code, for the purchase of classroom
13 supplies. Any savings
so allocated by a school district board of trustees
14 shall be considered specifically dedicated
for such purpose by enactment of
15 the State Legislature
for the purposes of any contract entered into by the
16 school district. Any savings so allocated
by a school district board of
17 trustees shall be used to augment,
and not replace, funds currently allocated
18 for the purchase of classroom supplies.
19 SECTION 24.
An emergency existing therefore, which emergency is hereby
20 declared to exist, Section 23 of this act
shall be in full force and effect on
21 and after passage and approval.
